Article 1 - Commencement of membership

Each membership starts on the 1st of the month. If you become a member during the month, a pro-rated partial monthly fee will be charged, after which the full membership fee will apply from the first of the following month. 

A membership has a minimum duration of 1, 3, 6, or 12 months, depending on the type of membership chosen. With this membership, you will have access to all facilities and group classes at Healthclub Zandvoort.

During the 1-week cooling-off period after signing the agreement, you have the option to terminate the agreement early. For online registrations, the cooling-off period is 14 days. 

The aforementioned right of withdrawal ends at the moment you make use of the facilities earlier. For prematurely terminating the agreement in this manner, an administration fee of EUR 22.50 will be charged.

• Cancellation is possible by sending an email to info@healthclubzandvoort.nl with the subject “membership cancellation” or in person at the club using the tablet provided for this purpose. Once we have processed your cancellation, you will receive a confirmation email. This email is binding. Cancellation must – except as stated above in the first week – be made no later than 1 calendar month before the end of the contract period, effective at the end of the month. This means: a cancellation at the end of the current month will take effect at the end of the following month. If cancellation is not made in time, the flex, 6-month, and 12-month memberships will continue for an indefinite period. During this period, the obligation to pay the membership fee to Healthclub Zandvoort remains, even if you (possibly) do not use the facilities. 

• Interim termination of your membership of more than 1 month (with due observance of the same notice period as mentioned above) is only possible if: 
• you move to a new address located more than 20 kilometers from the club. This will only be granted on the basis of an official municipal registration at your new address.
• it has become impossible for you to make use of the fitness activities for the remainder of the membership due to injury or illness. This will only be granted on the basis of an official doctor's statement.
• Any bar credit and/or accumulated balance will in principle not be refunded.

• If, as a result of injury, illness, or work obligations, you are completely unable to use the facilities for more than one month, it is possible (only upon presentation of a medical certificate from a doctor or an official letter from your employer) to temporarily freeze your membership. The membership can be frozen for a maximum of 3 months. Freezing the membership is only possible in full calendar months, starting from the next calendar month. The automatic direct debit will continue during the freeze, up to the end date of the membership. Subsequently, the subscription will automatically be extended free of charge by the same period as the duration of the freeze. During the freeze period, it is not possible to visit the club or use any other facilities included in the contract.

• The same applies if Healthclub Zandvoort is forced to temporarily close as a result of government measures or otherwise (for example, during the lockdown period due to Covid-19). In such a case, Healthclub Zandvoort will not collect membership fees for the period of closure, and the membership will be automatically extended by the duration of the closure. During the extension, the membership fee will be collected as usual.

• Healthclub Zandvoort is entitled at all times to change the opening hours, class schedules, and rates. On official public holidays, Healthclub Zandvoort reserves the right to close the club without this resulting in a reduction or refund of the membership fee.

• The collection of further amounts due that are not paid within the deadlines set by Healthclub Zandvoort will be transferred to a collection agency. All judicial and extrajudicial (collection) costs that Healthclub Zandvoort must incur as a result of non-compliance will be entirely at your expense. The compensation for extrajudicial costs is fixed at 15% of the principal amount due (with a minimum of € 40 per claim). In addition, statutory interest will be charged on the principal amount from the due date.

• Payment of the membership fee is made monthly by direct debit. You are required to ensure that there are sufficient funds in the account from which Healthclub Zandvoort is authorized to collect payment.
• The due membership fee is automatically collected in advance and at the end of the month. A possible second collection round takes place around the 14th of the month.
• For each invoice that is not paid within the specified period after the first reminder, we will charge you €7.50 in reversal fees.

• Each year, all memberships are subject to a price increase in accordance with the indexation of the C.B.S. for consumer prices. Healthclub Zandvoort will announce a price list one month before the effective date of the price increase. If the change involves an increase of 7% or more, the member has the right to terminate the membership within 4 weeks after the announcement by sending an email to info@healthclubzandvoort.nl with the subject “membership cancellation.” Article 3 remains applicable in all other respects.

• The membership applies exclusively to the specified activities and the indicated duration and price.

• Unless expressly stated otherwise, the membership is strictly personal and non-transferable.

• In the sports areas, appropriate sportswear must be worn at all times. In addition, it is mandatory to wear clean sports shoes and to use a towel. 

• To use the saunas, you are required to bring a bath towel and slippers.

• It is not permitted to use and/or trade drugs or, in general, stimulants. The use or trade of such substances will, upon discovery, result in immediate termination of membership, without any right to a refund of paid membership fees.

• Members are required to follow the instructions given by the staff of Healthclub Zandvoort and to comply with established regulations regarding, among other things, clothing, necessary order, and discipline (tank tops, noisy and/or inappropriate behavior or language are not permitted, as determined by the staff of Healthclub Zandvoort). In case of violation, Healthclub Zandvoort is entitled to deny members access to the club and to terminate the membership immediately, without any right to a refund of paid membership fees.

• Smoking is strictly prohibited in the club.

• The use of the facilities within Healthclub Zandvoort is at your own risk. 

• Healthclub Zandvoort is not liable for damages resulting from accidents, theft, fire, or any other damage-causing events, unless there is intent or gross negligence on the part of Healthclub Zandvoort.

• Each member declares, by signing the membership agreement, to comply with the general terms and conditions established by Healthclub Zandvoort and the house rules in effect at the club. 

• Healthclub Zandvoort is at all times entitled to deny access, for a period determined by Healthclub Zandvoort, to anyone who does not comply with the terms or rules, without any right to a refund of already paid membership fees.

• Healthclub Zandvoort is entitled to unilaterally amend these General Terms and Conditions. In such case, Healthclub Zandvoort will inform the members of the changes in a timely manner. There will be at least one month between this notification and the entry into force of the amended terms and conditions. 

• If you believe that the new General Terms and Conditions differ significantly from the current ones for you, you have the option to terminate the membership agreement as of the date the amended terms and conditions take effect.

• In all cases and/or situations not covered by the above general terms and conditions, decisions will be made exclusively by the management of Healthclub Zandvoort. All disputes arising between Healthclub Zandvoort and members will be settled by the ‘Fitness Disputes Committee’ or the competent court in Amsterdam. Dutch law applies to the membership.

• The personal data of the members is strictly confidential and is used solely and exclusively for administrative purposes of Healthclub Zandvoort. This data will never be made available to third parties for commercial purposes unless with explicit consent for commercial activities related to the Healthclub.
